LOGAN — The case for a 24-year-old Nibley man accused of sexually assaulting another inmate in the Cache County Jail is headed to trial. John M. Janisse, who has multiple drug convictions during the past year, is currently serving a one-year jail sentence for distribution of a controlled substance.

Janisse appeared in 1st District Court Monday morning. He was previously charged with forcible sexual abuse, a second-degree felony; and lewdness by a sex-offender, a third-degree felony.

Public defender Ryan Holdaway told the court they had been unable to resolve the case with prosecutors. He requested the jury trial, explaining that it should only last one day.

Judge Brian Cannell scheduled the trial for May 14. He also ordered Janisse to appear for a final pre-trial conference April 13.

According to a jail deputy’s report, the sheriff’s office received a complaint from an inmate in October. The alleged victim claimed Janisse exposed his genitals to him and, in a separate incident, touched the buttocks of the alleged victim with his genitals.

In February, Janisse waived his right to a preliminary hearing and pleaded “not guilty” to all of the charges.

Janisse was convicted of unlawful sexual activity with a minor, a third-degree felony in 2017. He could now face up to 15 years in prison on the new charges.
