LOGAN — A 32-year-old North Logan man, Brian Hurd has been sent to prison and ordered to serve his prior suspended sentence, after he was caught viewing child pornography and taking a photograph up a woman’s skirt.

Brian Hurd appeared in 1st District Court Monday morning after being arrested in August for violating his probation.

On February 3, 2014, Hurd pleaded guilty to one count of sexual exploitation of a minor, a second-degree felony. Under conditions of his plea, prosecutors dropped nine remaining charges. He was sentenced to serve one-to-fifteen-years in prison. The sentence was suspended under the agreement that he serve at least 180-days in jail and complete a sex offender program at the Northern Utah Community Correctional Center (NUCC). He was also placed on probation for three-years.

During Monday’s sentencing, Judge Thomas Willmore reviewed a report from probation officers, describing how Hurd was caught with a photo, taken up a woman’s skirt. The report said Hurd admitted to taking the photograph without the woman knowing.

Judge Willmore said probation officers also found photos and videos of child pornography on his smartphone, some downloaded just days before being caught.

Hurd claimed the child porn was on his Google account and was accidentally synced to his phone when he attempted to retrieve his phone’s contact files. He told the court he was taking his sex therapy seriously and wanted to be a better citizen.

Judge Willmore said he didn’t believe Hurd’s excuse and said he agreed with probation officer’s, that his sexual addictions were a threat to the community.

State attorney Barbara Lachmar said she was also concerned, learning that Hurd had started a photography business where women were sending naked photos of themselves to him, applying for modeling work.

Judge Willmore ordered Hurd to prison to serve the remainder of his one-to-fifteen-year sentence. He gave him credit for time served and said it would be up to the parole board to determine when he was released.
