LOGAN — A 52-year-old Logan man has been sentenced to jail for holding a woman against her will and sexually assaulting her. Daniel Mingott has been behind bars since being arrested in September.
Mingott was sentenced in 1st District Court Monday morning. He previously pleaded “no contest” to attempted forcible sexual abuse, a third-degree felony; and attempted aggravated kidnapping, a class A misdemeanor.
In September, Mingott reportedly held the victim in a bathroom while trying to rape her. The defendant continued to assault the woman until she pushed him out of the room and locked the door.
During sentencing, the victim tearfully told the court how Mingott, her ex-husband, had abused her for month’s leading up to the September assault. She explained how he lied and brainwashed her, to the point that she began secretly recording their interactions.
When the crime occurred, a video showed the victim telling Mingott “no” or “stop” more then 30 times.
The victim asked the court for the harshest sentence under the law. She said, “women have to start making men pay for their assaults.”
Mingott, who is originally from Peru, continued to deny committing the assaults. He claimed that he had been set up by the victim.
Judge Brian Cannell said he did not believe Mingott was being truthful. He noted that the defendant was in the country illegally and would likely be deported.
Judge Cannell sentenced Mingott to the maximum prison and jail sentence for each of the charges he pleaded “no contest” to. The sentence was suspended so the defendant can be deported by immigration agents.
Judge Cannell warned Mingott, he would send him to prison if he tried to re-enter the country illegally.
