LOGAN — A judge has ruled there is sufficient evidence to bind a 26-year-old former Logan man over for trial, accused of sexually assaulting a woman two years ago.
Judge Kevin Allen ordered Andrew Gutierrez to face charges of object rape, a first-degree felony and a newly added charge of forcible sex abuse, a second-degree felony.
During Tuesday’s preliminary hearing, state prosecutor Spencer Walsh said Gutierrez inappropriately touched the alleged victim while the two were watching a movie in her apartment.
The incident reportedly took place in August 2012, while the two were students at Utah State University.
Former Utah State Police officer Trevor Larson investigated the case. He testified that the alleged victim reported falling asleep while the two were in her apartment. When she awoke, the defendant was touching her privates and breasts.
The case has since been delayed, after the defendant moved to Boulder, Colorado to continue his education.
Judge Allen set the case for a three-day trial in July, to accommodate the defendant’s and alleged victim’s school schedules.
