LOGAN — A trial has been scheduled for a 49-year-old man arrested in Logan, who continues to fight extradition to California to face murder charges. Daniel J. Espinoza is being held in the Cache County Jail since being arrested last month.
Espinoza appeared in 1st District Court Monday morning. He was previously charged with one count of being a fugitive from justice.
On November 15, Espinoza was taken into custody after police officers were given information regarding his whereabouts. The suspect allegedly has quite a history in the valley and several ties to local residents.
During a preliminary hearing earlier this month, several law enforcement officers that were involved with Espinoza’s arrest testified regarding his identity. Judge Brian Cannell later ruled that prosecutors had sufficient evidence to prove the defendant’s identity and that he is wanted on suspicion of homicide.
Espinoza continues to refuse to be transferred to California. He is also allegedly filing a Writ of Habeas Corpus, claiming he is being unlawfully detained.
During Monday’s court appearance, Judge Cannel set a trial date for February 21. He also ordered Espinoza to remain in jail without bail.
